Commission Leaderboard Contest 2.0

Eligibility: The Commission Leaderboard 2.0 Contest ("Contest") is open only to eligible Bravado members residing in the United States, Canada (excluding Quebec), the United Kingdom, the Republic of Ireland, Australia, India, and Mexico that are eighteen (18) years of age and of the age of majority in the member's state or province of residence. Employees of Bravado, its parent and affiliated companies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Contest is subject to all applicable federal, provincial, state, and local laws and regulations and is void where prohibited.

  1. Official Rules: Participation in this Contest is subject to member’s full and unconditional agreement to the Bravado Terms and Conditions, these Official Rules and Sponsor's decisions, which are final and binding in all matters related to this Contest. Winning any prize is contingent upon fulfilling all requirements set forth herein.

  2. Timing: An individual Contest occurs weekly and begins on Monday of each week and ends on the following Sunday (each a "Contest Period") (e.g. April 10, 2023 - April 16, 2023, and April 17, 2023 - April 23, 2023). All times are Eastern Time (ET). Sponsor’s computer is the official time-keeping device for the Contest.

  3. Winner Determination: Each member has the ability to score Bravado Commission Points (“Points”) consistent with Bravado’s Terms and Conditions and Commission Points Program Terms (“Points Terms”) by engaging in qualifying activities (as determined by Sponsor in its sole discretion) using the Bravado service and App in an authorized manner during the Contest Period. The Community Manager of the War Room will announce the contenders for each category mid-week and declare the winners at the end of the week.

    The Bravado War Room Leaderboard awards users based on three core values that define the War Room experience: providing top-tier sales content, consistent engagement throughout the week, and transforming newcomers into seasoned sales savages. The leaderboard features three distinct categories of weekly winners: 

    Top Newcomer: The best contributor posting in the war room for the first time in the last 90 days,  as chosen by Bravado management.
    Top Commission Winner: The highest commission earner in the week.
    Top Quality Winner: The best quality content contributor in the War Room, as chosen by Bravado management. In the event of a tie, Sponsor reserves the right to give out multiple prizes or assign a tiebreaker skill challenge to determine the winner.

  4. Winner Requirements: Potential winners will be notified by email on or around two (2) business days following the conclusion of the Contest Period.   Except where prohibited, the potential winner may be required to sign and return a Declaration of Compliance, Liability and Publicity Release, which must be received by Sponsor within two (2) days of the date notice, or attempted notice, is sent in order to claim the prize. If a potential winner cannot be contacted, fails to sign and return the Declaration of Compliance, Liability and Publicity Release within the required time period, does not comply with these Official Rules, or prize is returned as undeliverable, the potential winner may be deemed by Sponsor to have forfeited its right to the prize.

    Except and to the extent prohibited by law, acceptance of the prize shall constitute and signify winner’s agreement and consent that Sponsor and its designees may use the winner’s name, Bravado handle, city, state, likeness, avatar and/or prize information in connection with the Contest and/or Bravado’s business for promotional, advertising or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration.

    Except and to the extent prohibited by law, the winner will indemnify Sponsor and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms.

  5. Prizes: There will be three (3) prizes offered (one for each category) in for Leaderboard 2.0:

    Top Newcomer: $20 USD Gift Card
    Top Commission Earner: $25 USD Gift Card
    Top Quality Content: $40 USD Gift Card
    Total value of prizes for each Contest is $85 USD.

    The approximate retail value of the prizes set forth above represents Sponsor’s good faith determination of the retail value thereof, and the actual fair market values, as ultimately determined by Sponsor, are final and binding and cannot be challenged or appealed.

    Limit one (1) Prize per person or household. All prizes awarded are non-transferable and cannot be redeemed for cash or credit (in whole or in part). All terms and conditions of gift cards apply. If any prize is not available, Sponsor reserves the right, at its sole discretion, to substitute the prize awarded with a prize of equivalent or higher value for any reason. Sponsor has made no warranty or guarantee in whole or in part, express or implied, in fact or in law, in relation to the use of any prize including, but not limited to, its quality, merchantability, fitness for a particular purpose or suitability for use. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Sponsor may issue tax documentation for prizes, such as a 1099 form for any prize with a value over $600, consistent with applicable law. Sponsor reserves the right to change the number of prizes and each prize (make/model) every week.

  6. Release: Unless and to the extent prohibited by law, by receipt of any prize, winner agrees to release and hold harmless the Sponsor, and its subsidiaries, affiliates, suppliers, distributors, and each such company’s officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.

  7. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.  If terminated, Sponsor may, in its sole discretion, determine the winners from among all non-suspect, eligible individuals.  Sponsor, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the operation and/or administration of the Contest, or to be acting in violation of the Bravado Terms and Conditions, Points Terms or these Official Rules in an unsportsmanlike or disruptive manner. Sponsor reserves the right to extend the Contest Period or not award all prizes in the event an insufficient number of individuals do not meet the minimum number of Points. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of its Terms and Conditions or these Official Rules shall not constitute a waiver of that provision.

  8. Limitations of Liability: Unless and to the extent prohibited by law, Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by member, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of the Contest, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen communications; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from participation in the Contest or receipt or use or misuse of any prize. Released Parties are not responsible for misdirected or undeliverable communications or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof.

    Release and Limitation of Liability relating to entrants from the UK and Republic of Ireland only: Notwithstanding any other rule in these Official Rules, to the fullest extent permissible by law, Sponsor will not be liable for: (i) any loss, liability or damage caused by someone other than Sponsor or someone acting under Sponsor’s direct instructions and in accordance with Sponsor’s instructions; (ii) any loss, liability or damage caused by any event or circumstance beyond Sponsor’s reasonable control; (iii) any loss of profits or revenue, loss of anticipated savings or loss of goodwill; or (iv) any unavailability of Sponsor’s platform, website or app. However, in relation to entrants from the UK and Republic of Ireland, nothing in these Official Rules shall in any way limit or exclude the Released Parties’ liability in relation to death or personal injury caused by negligence, for fraud, or any other type of liability which may not be lawfully limited or excluded.  In relation to entrants from India, this release does not apply to personal injuries, death, damages, or losses caused by released parties’ intentional or gross negligence, or fraudulent representation.

  9. Disputes: Except and to the extent where prohibited by law:  (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of California and/or state courts based in San Francisco, California; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees; and (3) under no circumstances will member be permitted to obtain awards for, and each member hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the member and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules which would cause the application of the laws of any jurisdiction other than the State of California. 

  10. Personal Information: Information collected from members is subject to Sponsor’s Privacy Policy.

  11. Winner List: The winners will be announced on the Bravado War Room site after winner confirmation is complete. The leader board will be available through the Bravado site during the Contest Period.
